
KARACHI: The parents of 20-year-old Shahzeb Khan, who was gunned down on the night of December 24, 2012 in Defence area, have filed an application in Sindh High Court (SHC), pardoning killers of Shahzeb in the name of God.
The family decided to pardon the culprits responsible for their son's death on Monday.
The victim's family moved an application in court stating that they have decided to pardon the murderers "in the name of Allah", without any pressure or coercion, and that a settlement was reached outside the court.
Advocate Mehmood Alam, representing victim's family, also filed affidavits on behalf of the victim's heirs - Aurangzeb Khan, Ambreen, Maha and Pareshay.
His friends Nawab Siraj and his brother Sajjad Ali Talpur accompanied Shahrukh Jatoi, when he gunned down Shahzeb Khan, 20, on the night between December 24 and December 2012 in Defence area.
Ealier, Shahrukh Jatoi along with Nawab Siraj Ali Talpur was sentenced to death while Siraj's brother Nawab Sajjad Ali Talpur and his employee Ghulam Murtaza Lashari were sentenced to life imprisonment by ATC on June 7, after finding them guilty of murdering Shahzeb Khan in Defence area on December 24 last year.
The prosecution alleged that Ghulam Murtaza Lashari, an employee of Siraj Talpur, teased Shahzaib's sister that resulted in bickering between Shahzaib and Shahrukh Jatoi, Siraj Talpur and others.
According to the prosecution, the accused followed Shahzaib, who left the house in his vehicle after the brawl, and later, on the instigation of absconding co-accused Asif Lund and Salman Jatoi, accused Shahrukh Jatoi and Siraj Talpur assualted Shahzeb with pistols at Khyaban-e-Bahria near Mubarak Masjid. The victim Shahzeb succumbed to his injuries at the Ziauddin Hospital.
An FIR was filed against the culprits under Section 302 at Darakhshan police station.
23 witnesses and two eye-witnesses had recorded their statements during the trial, after which an anti-terrorism court (ATC) in Karachi sentenced the main accused, Shahrukh Jatoi, to death along with Siraj Talpur; while life-long jail terms had been given to Sajjad Talpur and Ghulam Murtaza Lashari on June 7.
Meanwhile, Shahrukh Jatoi, the main convict in Shahzeb Khan's murder case and other convicts, have also filed appeal in the SHC against his conviction by Anti-Terrorism Court.
They submitted in appeal that the trial court erred in its judgment by convicting the appellant and said that the prosecution miserably failed to prove its case beyond any shadow of doubt.
He submitted that there existed glaring contradictions and dishonest improvements in the statements of prosecution witnesses, which could not be sustained in the eyes of the law as well as the rulings of superior courts.
They prayed the court to set aside the trial court's order as the prosecution could not establish its case sufficiently, and order the release of the appellant. ppi
It truly represents that money talks, as according to news the application was submitted for the resolution of matter out of court, which could have been done prior to the court announced death sentence to the accused. Furthermore, the family was receiving threats as has been heard, they could have stated so in the court and asked for justice’

As reported by a private TV channel Shahzaib's kin and Jatoi family settled the matter on a payment of Rs 350 million, along with residential visa for Australia. If true, there can be no better way-out for the dejected family. There were rumours doing the rounds for last couple of months that justice won't prevail in this case, as Shahrukh's father enjoys strong political clout, and we've seen the end result yesterday’
